1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded through Strategify's website (hereinafter “we”, “us”). By purchasing a service on our website, customers (hereinafter “customer”) agree to these GTC.

2. EU AI Act: Declaration on the Use of Artificial Intelligence “AI” at Strategify

At Strategify.ch, we use modern AI technologies such as Perplexity, Claude, ChatGPT, CoPilot, or other GenAI tools to assist you in creating your application documents. The AI serves merely as a tool to provide you with an additional perspective (“Second Opinion”).
Important: You make all decisions about your application documents yourself. The AI does not make automated decisions but helps to professionally compose your documents. We recommend that you carefully review the results and adjust them according to your needs. This way, you always remain in control!

3. Subject of Contract and Service Description

Strategify offers intangible services that are provided based on information supplied to us by customers.

Our services include, among others, consulting and analysis services that are tailored specifically to the needs of the customers.

The descriptions of individual services on our website are binding, subject to any changes or errors.

4. Contract Conclusion

By clicking the “Buy” button in the webshop, the customer makes a binding offer to conclude a purchase contract.
The contract is only concluded with our written confirmation by email or by providing the service.

5. Payment Terms

All services must be paid in advance. The receipt of payment is a prerequisite for the provision of the agreed service.

Payment can be made through the payment methods specified on our website.
After successful payment, the customer receives a confirmation by email.

6. Customer's Obligations to Provide Information

The customer agrees to provide us with all necessary information required for the provision of the service.

Strategify reserves the right to begin the service only after receiving all required information and after reviewing it.

The customer guarantees that the information provided is correct and complete. Incomplete or incorrect information may result in delays or termination of the service.

7. Handling of Information and Data Protection

Strategify commits to handling the information provided by the customer carefully and confidentially. The information will be used exclusively for the purpose of providing the commissioned services.

Strategify expressly commits not to use customer information for its own projects or to utilize it in any other way unless there is explicit written consent from the customer.
All information is subject to our privacy policies and is processed in accordance with applicable data protection laws.

We take appropriate technical and organizational measures to ensure the protection of information and to safeguard it against unauthorized access.

8. Liability

To the extent permitted by applicable law, neither Strategify nor its partners, shareholders, consultants, employees, affiliated companies, or other representatives of Strategify are liable for losses or damages arising from or in connection with the use of the materials or facilities or services offered through this website (including but not limited to indirect or consequential damages, loss of data, income, profit or opportunities, loss or damage to property and third-party claims), even if Strategify has been advised of the possibility of such losses or damages or such losses or damages were reasonably foreseeable.

When providing information, the customer bears responsibility for the accuracy and completeness of the details. Strategify assumes no liability for damages resulting from incomplete or incorrect information provided by the customer.

Strategify is not liable for loss of profit or intangible damages.

9. Warranty and Complaints

Strategify guarantees that the services will be provided in accordance with the contractual agreements and with due diligence.

If defects in the provided service are identified, the customer must report this in writing within 14 days of receiving the service.

If justified, Strategify will either rectify defects or offer an appropriate replacement of the service. Further claims are excluded.

10. Cancellation Terms

Consulting: If the client terminates a consulting project prematurely, all expenses incurred up to that point plus 50% of the expenses not provided according to the order are owed.

Coaching: After a non-binding and free initial consultation, the amounts owed in the offer are to be paid upon the start of the coaching program, even if the program is terminated prematurely. For health reasons or due to extended absences, the program and/or coaching can be interrupted, but for no longer than 3 months.

Individual Coaching: After a non-binding and free initial consultation, appointments for individual coaching sessions are planned individually. The agreed costs are incurred for completed coaching sessions. Cancellations within 24 hours will be charged at 50%.

Training: In case of cancellation later than 45 days before the training date, 50% will be charged, and if later than 30 days before the start of the event, the full seminar price will be charged. In the absence of a written cancellation, the full seminar price becomes due.

Expenses and Third-party Costs: Travel expenses according to actual expenditure (1st class train or car CHF 0.85/km), meals/accommodation according to actual expenditure. Costs for third-party services such as hotel, translations, and production of aids are covered by the client or billed, unless otherwise agreed.

11. Right of Withdrawal

As these are intangible services that are individually created for the client, there is no statutory right of withdrawal after the service has been provided.

12. Severability Clause

Should these regulations or parts of these regulations be or become invalid, this shall not affect the validity of the remaining regulations. The invalid regulation is to be replaced by a regulation that comes closest to its economic purpose.

13. Applicable Law and Jurisdiction

The General Terms and Conditions of Strategify are subject to Swiss law. The place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions is Aarau, Switzerland.
